GENERAL
This site is owned and operated by Glasir Asgard Sdn Bhd (Company No. 1186469M). If you have any queries about these terms and conditions or if you have any comments or complaints on or about our site, you can contact us here.

1. Definitions
In these Terms and Conditions:
The term "Hieno" or "our" or "us"or "we" refers to the owner of the website.
"You" means refers to the user or viewer of our website and the Customer who places an Order;
"Site" refers to Hieno.store website;
"Account" means the Hieno Account that you will need to register for on the Site if you would like to submit an Order on the Site;
"Business Day" means any day on which retail banks in Malaysia open for business;
”Order Confirmation" means our email to you, in which we acknowledge your Order in accordance with clause 4(b) below;
"Contract" means your Order of a Product or Products in accordance with these Terms and Conditions which we accept in accordance with clause 4(b);
"Customer" means any individual who places an Order on the Site;
"Order" means the Order submitted by you to the Site to purchase a Product from us;
References to "clauses" are to clauses of these Terms and Conditions;
"Packaging" means the original material used to wrap the product and is a retail-ready packaging in accordance with clause 9(a);
"Parcel" means an object or collection of objects with retail ready packaging wrapped in corrugated papers or in a box ready to be carried or sent by post packaging in accordance with clause 9(b);
"Date on which we begin provision of the services"- the date when we begin processing your order upon your confirmation and payment for your order in accordance with clause 9(c);
"Days of your receipt of goods" - days after the acknowledgement date recorded by postal service in which you or your representative received the goods in accordance with clause 9(d).

2. Ownership of rights
All rights, including copyright, in this site, are owned by or licensed to Glasir Asgard Sdn Bhd. Any use of this site or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this site for any purpose.

From time to time, this site may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s). Your use of these website(s) and any dispute arising out of such use of these website(s) is subject to the laws of Malaysia.

We have no control over the nature, content, and availability of those websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep the site up and running smoothly. However, Hieno takes no responsibility for, and will not be liable for, the site being temporarily unavailable due to technical issues beyond our control.

a) Website
We have taken all reasonable care in the preparation of the content of this site, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described.

The information contained in this site is for general information purposes only.

The information is provided by Hieno and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the site or the information, products, services, or related graphics contained on the site for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this site.

b) Catalogue Product Pricing & Descriptions
Colours displayed in our product photographs can and may vary on different PC or mobile displays.

Any weights, dimensions and capacities given about the goods are approximate only.

Please note that we are unable to confirm the price of a product until your order is accepted in line with our order acceptance conditions.

We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this website and in the catalogue are solely to provide an approximate idea of the goods they describe and do not form part of the contract between you and us and are not intended to be binding. We do not give any warranty as to the accuracy or completeness of the information and cannot be responsible for any errors or omissions or for the results arising from the use of such information.

The prices payable for goods that you order are as set out on our website and are in MYR (Ringgit Malaysia) and are correct at the time of entering information. Prices exclude delivery or SST/GST where applicable.

Wherever it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email, offer to sell you the goods of the specification and description at the price stated in the email and will state the period for which the offer or the price remains valid.

4. Ordering Terms (Making a Purchase and Availability)
a) Registration

To place an Order, you must register with us by creating an Account on the Site. You must only submit to us information which is accurate and true. You must also keep your information up to date by informing us of any changes, by using the relevant sections of the Site.
You shall not misuse the Site by creating multiple user accounts.

b) Formation of a Contract

The information set out in the Terms and Conditions and the details contained on this Site does not constitute an offer for sale but rather an invitation to treat. No Contract in respect of any Products shall exist between you and us until we have shipped the Products to your designated address.
To submit an Order, you will be required to follow the online shopping process on the Site. After this, you will receive an Order Confirmation which will act as an acknowledgement of your Order.
An Order is only considered accepted by us upon your Order being shipped to the delivery address provided by you.
A Contract will relate only to those Products which we deliver to you. If your Order consists of more than one Product, the Products may be delivered to you in separate packages at separate times.

Please note that promotional codes are valid for in-stock items only. Only one promotional offer can be used at any one time and any Promotion Codes are not valid during Sale Periods. All promotional codes remain the property of Glasir Asgard Sdn Bhd and we reserve the right to stop or remove a promotion at any time without prior warning. Kindly refer to our "On Shopping Process" section in our Ordering & Payment policy.

5. Payment Terms
Our online Payment process is operated through Paypal and/or iPay88, a secure server. All card information is encrypted using the security technology and passed directly to Paypal and/or iPay88 for authorization. No credit card information is stored on the Glasir Asgard Sdn Bhd's server at any time. We will charge your credit account for payment upon receipt of your order unless delivery cannot be fulfilled for unexpected reasons.

Please note that your payment transaction will appear as Glasir Asgard Sdn Bhd on your credit/debit card statement. Alternatively, payment by cash deposit is also accepted (only in Malaysia). All payments must be cleared by the bank before the order can be dispatched. A voice mail is used outside of business hours: please leave your name & number and we will return your call.

We accept no liability if a delivery is delayed due to incorrect payment details provided. We reserve the rights to cancel and or suspend your order if the full payment is not received within the stipulated time (12 hours from the time of order). This does not affect any other rights we may have.

6. Shipping and Delivery Terms
Delivery charges vary according to the type of goods ordered and cannot be refunded. They are set out clearly under the Shipping & Delivery policy.

We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

7. Order Tracking
Once your order has been dispatched, you will receive an email containing a tracking number. You can use it to track your order on the courier’s website. 8. Risk and Ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

9. Exchange and Return Policy
We hope that you will be delighted with your order, however, there may be an occasion where you need to return, an exchange or a refund.

10. Disclaimer of Liability
The content displayed on this Site is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary and to the fullest extent permitted by law, Glasir Asgard Sdn Bhd and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Site and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.

Nothing in these Terms and Conditions shall exclude or limit Glasir Asgard Sdn Bhd’s Liability for death or personal injury arising from its negligence, fraudulent misrepresentation, and misrepresentation as to a fundamental matter or any other Liability which cannot be excluded or limited under applicable law.

11. Indemnity
You agree to indemnify, defend, hold harmless Glasir Asgard Sdn Bhd, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including but not limited to, legal fees) arising from your use of this Site or your breach of the Terms and Conditions.

13. Circumstances Beyond Our Control (Force Majeure)
We shall not be liable to you for any breach, hindrance or delay in the performance of a Contract attributable to any cause beyond our reasonable control, including without limitation:

Strikes, lock-outs or other industrial action
Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters.
Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Impossibility of the use of public or private telecommunications networks
The acts, decrees, legislation, regulations or restrictions of any government, shipping, postal or other relevant transport strikes, failure or accidents.

In the circumstance that the Force Majeure event lasts for more than one week, either you or we may terminate the Contract forthwith by written notice and without any Liability other than a refund of a Product already paid for by you and not delivered.

If we have contracted to provide identical or similar Products to more than one Customer and are prevented from fully meeting our obligations to you by reason of a Force Majeure event, we may decide at our absolute discretion which Contracts we will perform and to what extent.

We reserve absolute discretion on the solution we adopt in fully meeting our obligations under the Contract despite the Force Majeure Event.

14. Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at displayed at 'Contact Us' page and all notices from us to you may be displayed on our website from to time.

15. Changes to Legal Notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

16. Law, Jurisdiction, and Language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with Malaysian law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of Malaysia.

17. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

18. Privacy
You acknowledge and agree to be bound by the terms of our privacy policy which are clearly stated on our website under the Privacy Policy section.

19. Third Party Rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
